PROOF OF LEGAL POST-1937 MEDICAL MARIHUANA SALES


According to Oklahoma Narcotics polices own website:
        http://www.ok.gov/obndd/Education/Marijuana_Fact_Sheet.html   -   The following is stated:
"But after close examination, the Food and Drug Administration in 1937 declared it [Medical Cannabis] to be without medical utility and removed it from the market place."
This is not at all technically correct, Medicinal Cannabis (Medical Marihuana) was legal up until the early 1970's.   What did occur in 1937 was the passage of the dreaded M.T.A. (Marihuana Tax Act), which at the height of the great depression placed a one dollar an ounce tax on ALL Cannabis medicines, but did NOT outlaw them.   That would have been impossible as Medical Cannabis (Medical Marihuana) simply had too many medical uses.   However, it did make it very ECONOMICALLY difficult for manufacturers too continual to provide the quality medicines as they had in the past.

To establish this point (below), we present several Federal documents (located via the National Archives in College Park, MD.).   Note that they are all taken from D.E.A.(then known as the Bureau of Narcotics) record files.   [If the reader needs better quality documents, feel free to contact us, most likely we can simply email them to you.]

Under the law a physician can write a prescription for marihuana and a pharmacist can fill it.   But the use of this drug for medical purposes is considerd nil.   It has no therapeutic value whatsoever.   Therefore, both in the United States and countries abroad, marihuana has been dropped from most of the listings in pharmacopoeias.

MUSEUM COMMENTS:   Much can be said about the above statements, --- that they contain (ah, how shall we say it), great inaccuracies, etc.   Here it is enough to say that the part about a Doctor (technically) being able to write a prescriptions for Medicinal Cannabis (Medicinal Marihuana) is about the only accurate thing being said.   And is being presented here solely as proof that the (legal) use of Medical Cannabis (Medical Marihuana) did not end in 1937 as claimed by the Oklahoma State Narcotics Police.


As additional proof, we present the following documents.   The first two of which consists of back and forth letters between a druggist and the D.E.A. (than known as the Bureau of Narcotics):

This next letter (in reply to a request for the information) gives the names of some distributors/manufacturers of Medical Cannabis (Medical Marihuana) Medicines.   Note that the year is 1941.

Once more (in reply to a request for the information) the D.E.A. (than known as the Bureau or Narcotics) gives the names of some manufacturers of Medical Cannabis (Medical Marihuana) Medicines.   Note that the year is 1949.

Below is shown (part of) a from that indicates that a drug store in New Orleans was still (legally) selling Medical Cannabis (Medical Marihuana) Medicines up to that time.   Note that the year is 1961.

Clearly this shows that Medical Cannabis was being sold legally (in local drugstores) during the 1960's.
